ISLAMABAD (Jehanzeb Abbasi, Hasnat Malik Departmental action against any government employee can be taken within two years of retirement. The Supreme Court issued a five-page detailed judgment written by Justice Musrat Hilali. It should be clear. Afzal Anjum was posted as Chief Engineer in Rawal Dam Division, Islamabad. The Punjab Irrigation Department issued a show cause notice to him 3 years after his retirement minutes, alleging irregularities and malfeasance. The Inquiry Committee in November 2020 suggested that Rs 55 lakh be withdrawn from the pension of the Executive Engineer. However, in February 2022, the Service Tribunal quashed the departmental order and ordered payment of pension and benefits. Under Section 21 of the PEEDA Act, 2006, departmental action can be taken within two years of the date of retirement. The Supreme Court in a judgment has laid down the principle that the purpose of PEDA law is to achieve the goal of good governance and self-accountability among public servants. This law applies to the serving and retired employees, against whom action has been taken within one year of retirement. The said employee retired on January 10, 2017, while the departmental action against him was started on February 24, 2020, which is a violation of the PEDA Act, 2006, hence the appeal against him was rejected.
